Former IRS Special Agent Joe Banister was joined by Shawn O’Connor of Free Enterprise Society Services (shawnoconnor.org), presenting “Phase II” of a discussion on federal tax withholding (the “Phase I” discussion broadcasted on February 6th, 2015). During the first half of the show we provided a recap of the “Phase I” show discussion (principles of statutory interpretation, statutory construction, the Supreme Court case precedent, history of tax withholding in the U.S. and relevant statutes pertaining to U.S. tax witholding laws) and in the second half we illustrated, using Sullivan v. United States, 788 F.2d 813 (1st Cir. 1986), the deceitful manner in which appeals courts have warped the plain language of the Subtitle C withholding statutes such as 3401(a); 3401(c) and 3401(d) and described the efforts of businesswoman Vivian Kellems to expose the post-Word War II tax withholding scam. Shawn again offered to provide a wealth of additional documents to any interested researcher if they send him a postage paid envelope and a “thumb” drive with sufficient memory to save the documentary data files.
